The Director Trade Organisation (DTO) in the light of the decision of the arbitration tribunal of Federation of Pakistan Chambers of Commerce and Industry (FPCCI) has nominated an officer of Export Promotion Bureau (EPB, Quetta to supervise fresh election of the Chaman Chamber of Commerce and Industry (CCCI).
Earlier, VII senior civil judge, Karachi South, on a suit filed for declaration and permanent injunction against the Federation of Pakistan Chambers of Commerce and Industry (FPCCI) by CCCI had found "no prima facie appears to grant ad-interim injunction at this stage without considering the defence of rival side."
The Chaman CCI's counsel had also moved an application praying to restrain the FPCCI and his persons of any kind not to hold fresh election of the CCCI executive committee.
The civil judge in his order passed on November 28 said that the counsel for CCCI hardly pressed for ad-interim injunction. While the counsel filed power on behalf of FPCCI and argued that suit was barred under Trade Organisations Ordinance, 1961, therefore, he vehemently opposed for grant of ad-interim injunction.
The order said that the case had been filed on November 25 and counsel for FPCCI sought time for filing the counter affidavit. "I find no justification at this stage to grant ad-interim injunction. However, the application will be decided on merits after completing in requirement of relevant law."
The FPCCI had received application from Haji Jamal Din, Director, Khojak Trading Company on October 16 for arbitration in dispute over election of executive committee of CCCI for the year 2006-07. Another application was received on October 21 from Muhammad Hashim and Brothers making similar complaints about election of the same chamber. FPCCI President in consultation with the vice-presidents, constituted on October 30 an arbitration tribunal under section 12 of Trade Organisation Ordinance, 1961 to arbitrate in the dispute.
After listening to the arguments and counter arguments and going through the written documents the arbitration tribunal had concluded that the elections in CCCI were not conducted fairly and, therefore, gave its award that the whole election process be started afresh and elections for the nine members of the executive committee be held again under supervision of DTO.
