The Establishment Division will soon issue a notification for extending powers of the Federal Board of Revenue (FBR) Act, 2007 to FBR Chairman, implementing new structure/functions of the top FBR management.
Sources told Business Recorder on Wednesday that the next board-in-council meeting would adopt a resolution for notifying powers of members and directors-general through Federal Board of Revenue Rules 2007. The council would issue notifications for enforcement of FBR Act, authorising the chairman to distribute power and functions among members.
Through another notification, the government would announce the date on which the remaining provisions ie, section 2 to section 24 of FBR Act, 2007 will come into force.
Sources said that the Secretary General Revenue Division could not obtain FBR powers on its own. In this connection, the Establishment Division would issue the necessary notification. Legally, powers of the Secretary General Revenue Division have to be notified by the said Division.
Through this notification, the incumbent Chairman would continue to perform the functions and exercise powers of the Board under the FBR Act, 2007. Under the new Federal Board of Revenue Rules 2007, the board may delegate its powers and functions to the chairman or the line member, functional member and support member who shall transact such business, and exercise such powers and functions, singly, as board, as may be allocated to him.
Sources said that the FBR Act, 2007 would provide rules of procedure of the board; Internal Job Posting; appeal rules; rules in respect of IMC; voluntary severance scheme rules; FBR foundation rules; and any other matters falling under sections 4 (powers and functions of the board) and section 5 of the FBR Act, 2007.
The chairman will distribute the powers and functions and the business of the Board among its members as he may deem expedient. Until the powers, functions and business of the Board is not delegated or distributed under this rule, any power exercised, function performed and business transacted by the chairman or a member shall be deemed to have been allocated to him.
According to rules, any powers, functions or business of the Board so exercised or transacted by the Chairman or any member may be ratified by the board provided that the powers so exercised, function performed and business transacted. The Board may require its orders and decisions to be issued or notified under the signature of a member or the Secretary.
