The Lahore High Court (LHC) has observed that the ministers and members of the parliament have no right to command removal or transfer of government employees under any law. The court while cancelling the dismissal order of a head clerk, Shakoor Ali by the health minister held that there is no law in the country that empowers parliamentarians to interfere in the affairs of transfers and postings of the government employees.
The petitioner through his counsel, contended that the EDO (health) passed his transfer orders on May 14 and referred the matter to the secretary health. He moved an application to the high ups against his transfer, but he was posted at the office of EDO (health) Sialkot.
Further, he moved a petition in the LHC that directed the secretary health to redress the grievance of the petitioner but the secretary had cancelled his transfer order. The petitioner pleaded to the court that a member of Punjab Assembly, Shazia Ishaq manoeuvred against him and approached the health minister to act against him. Finally, the minister passed the cancellation order on July 11.
