Justice should not only be done but be seen to be done, is said to govern judgements by courts. As against this principle, a recent judgement is singular in that it fines petitioners for bringing the petition. In case of failure to pay the fine petitioners will suffer imprisonment. Such judgements were often delivered by military courts.
It is another thing, though, that the draconian character of those judgements did discourage necessary litigationing. In the instant case the petitioners had, inter alia, requested for constitution of a bench which was larger than a three-member bench. The petition failed, and the petitioners got penalised.
