The sedition petition filed against former President, General Pervez Musharraf, in Sindh High Court last Saturday, was under objection in the Registrars office. Advocate Suhail Waheed has accused Musharraf of committing high treason by instigating COAS, in a recent media talks here, to impose martial law in the country.
The petitioner has asked the High Court to try Musharraf under Article 6 of the Constitution of Pakistan. "How this petition is maintainable against the respondents No 1 to 5 under Article 248 of the Constitution of Pakistan," said the objection made available to Business Recorder.
Here, it is pertinent to mention that the petitioner has made President Asif Ali Zardari, Prime Minister Yousaf Raza Gilani, Chief of Army Staff General Ishfaq Pervez Kiyani and the Ministry of Interior as respondents in the suit. Sources in the Writ Branch said that under Article 248 no petition could be filed against the five entities mentioned in the petition.
About any development, they said the suit was awaiting petitioners response to the objection. "Usually a lawyer does not pursue most of his petitions like this one, which is desperately awaiting his response," sources added. However, talking to Business Recorder, Advocate Suhail said he had resolved that he would seriously pursue the case, and would reply to the objections.
