The Council of Islamic Ideology (CII) on Friday, under section 332 of Pakistan Penal Code, unanimously recommended to include domestic violence in the definition of Zarar (inflecting any injury or damage). The CII voiced concern over the increasing number of domestic violence cases, and discussed ways and means to prevent the phenomenon.
In its 173rd meeting, presided over by Dr Khalid Masood, the Council regretted that domestic violence was not considered a criminal offence "in our law and culture". The CII endorsed its previous recommendations made for Hudood, Qisas and Diyat ordinances. It also recommended to give opportunity of appeal to the affected party under the Employees Old-Age Benefits (Determination of Complaints, Questions and Disputes) Regulation, 2007. The Council also recommended change in the clauses 19(B) and 41(E) of the Guardian and Wards Act, 1890, giving equal parenthood rights to both the mother and the father.
The Council has also recommended changes in Articles 5, 14, 15, 16, 19 and 21 of the present marriage contract. The CII also discussed law pertaining to loans issuance and write-off, and decided to present a brief report on the issue in its next meeting. The Council also decided that, as per written clarification of Law Ministry and under section 230 of the constitution, the CII would directly send its recommendations, pertaining to legislative business, to Senate Chairman, National Assembly Speaker, and the speakers of all the four provincial assemblies.
It also recommended inclusion of drafting as a subject in the course of all law colleges. Council members who attended the meeting were Dr Manzoor Ahmed, Dr Mohsin, Muzaffar Naqvi, Dr Faiz Builqees, Dr Munir Ahmed Mughal, Justice Ahmed Jalandhari, Moulvi Abdullah Khiljee and Justice Afzal Haider.
