Advocate Khawaja Haris Ahmad representing Punjab Assembly Deputy Speaker before a full bench of the Lahore High Court, hearing several identical petitions challenging Governor Rule in Punjab said that if the Supreme Court suspends Sharif brothers disqualification judgement, then the hearing of present petitions will be a futile exercise.
He said the matter has become subjudice before the SC, as federation itself has moved the apex court through a review petition praying suspension of the impugned judgement, to be heard on March 30 and requested the court to adjourn these petitions till the decision of the matter by SC.
Counsel for another petitioner, Advocate AK Dogar, also endorsed the point of view of Khawaja Haris saying that SC has already issued notice for March 30 in the said matters. A Deputy Attorney General of Pakistan, Nasim Kashmiri also informed the court that he had received information from Advocate-on-Record about the fixation of the matter by the SC for March 30.
However, counsel for the petitioner, Nadeem Malik, Dr Farooq Hassan advocate was of the view that the matter should be heard on its merits. At this the bench observed, It has been made clear to all that the Court is not, in any way, going to avoid the hearing of the matter, which involves the interpretation of provisions of the Constitution. However, in view of the preponderant stance of the counsel and the law officers, we have deliberated on this aspect of the matter and are inclined to adjourn the matter till 31.3.2009. The bench directed the office to fix the case on March 31 along with all connected matters.
