Rawalpindi police here on Tuesday produced before Lahore High Court (LHC) a three-year-old son Muhammad Ali Asqa of a polish woman after recovering him from his father Muhammad Khan. The court retained the passport of the minor in court's custody, and allowed him to go with his father till next date of hearing on March 05 and directed him to furnish surety bonds worth Rs 2.5 million.
The court was hearing a habeas corpus petition filed by Justyna Bernadetsa of Poland for the recovery of her son from the custody of her former husband, Muhammad Khan. The counsel of Muhammad Khan contended before the court that the petition is not maintainable hence dismissed the same. The petitioner counsel, however, sought time to plead his case.
The court therefore, adjourned the proceedings till next date of hearing and handed over the boy to his father after directed him to submit surety bonds. During last date of hearing the court had directed DPO Rawalpindi to adopt all necessary legal means to recover and produce respondent Muhammad Khan and his minor son in the court on next date of hearing.
As per details, the petitioner Justyna Bernadetsa of Poland through her counsel submitted that she married to Muhammad Khan of Rawalpindi some years back in Birmingham, UK. And they had a baby boy out of this wedlock, who also born in a hospital of Birmingham on March 7, 2006.
Later they shifted to Pakistan along with their child Muhammad Ali Aqsa and started living in Rawalpindi. However, due to some unavoidable reasons Muhammad Khan divorced her but kept the child in his possession. She said the act of her former husband was illegal, as their son being minor should be given in her custody. She, therefore, prayed to the court to get her child recovered from the illegal custody of his father and hand over to her.
