A constitutional petition has been filed before the Supreme Court again challenging levy of "Luxury Tax" on imported vehicles, after removing objections raised by registrar office of the apex court. The petition was filed by Dada Enterprises (pvt) Limited and others through their counsel Muhammad Azhar Siddiqui submitting that the Luxury Tax was introduced by incorporating Section 6 in the Punjab Finance Act, 2008 (the Act).
Counsel said that the Act related to tax on imported luxury vehicles was incomplete, incoherent, uncertain and vague law. The provincial government was already charging and receiving Motor Vehicle Tax, so had no authority to charge Motor Registration Fee and the Luxury Tax, he said.
Azhar maintained that the respondent authorities had no authority under the law to collect any fee or tax, which had already been collected adding that this amounts to double taxation and under the rules of interpretation of statues no one can be vexed twice.
