The Lahore High Court (LHC) here Wednesday allowed a girl to marry her fiancé, who is facing death sentence, and ordered Superintendent Kot Lakhpat jail to make arrangements for their marriage inside jail. The court passed these orders in the petition of Laiba Saher, resident of Samanabad, who through her counsel contended that she was engaged to Muhammad Attique in her childhood.
She said her fiancé was awarded death sentence in a case and was detained in Kot Lakh Pat jail. She wanted to enter into marriage contract with Attique, but jail authorities were not allowing her. She pointed out that it was her fundamental right to get married and a prisoner also enjoyed the same rights.
On court's direction Superintendent jail submitted a report, stating that prisoner Attique was a hardened and desperate criminal as he was awarded death sentence in one case and more than 10 cases of heinous crimes like kidnapping for ransom and murder were still pending against him in different courts. He pointed out that Pakistan Prison Rules did not carry any provision for arrangements of a prison's marriage inside jail premises. The court, however, accepted girl's petition and directed superintendent to make arrangements for marriage.
