The Lahore High Court here Wednesday dismissed for non-prosecution an application for determining the government functionaries who facilitated release of Raymond Davis. A member bar Rana Ilamuddin Ghazi submitted that trial judge acted in haste and left lot of lacunas in the case.
The petitioner alleged that Additional Sessions Judge Muhammad Yousaf Aujla acted in sheer violation of Sharia law as neither identification of all legal heirs was confirmed nor any time was given to ascertain the fact whether all of them made statements without coercion and duress. He alleged that Raymond had remained involved in anti Pakistan activities for three years but the investigators did not probe him on these lines.
He said that Additional District Sessions judge Yousaf Aujla, police and other officials failed in fulfilling their responsibilities and crossed all limits in favouring the accused in his release. He said that name of the accused was on ECL on the orders of the LHC but even then he was sent abroad. On Wednesday, the court dismissed the plea after the Petitioner-counsel failed to appear before the court.
