Missing persons' case: Supreme Court expresses annoyance on delay in appointing head of JC
The Supreme Court on Thursday expressed its annoyance on delay in appointing head of Judicial Commission, formed for probing the missing persons' case. The SC had issued several directives to federal government for the last three months to make appointment of the commission head but orders were not responded so far.
A two-member bench headed by Justice Nasir-ul-Mulk was hearing the missing persons case where Additional Attorney General KK Agha prayed for more time so that head of the commission could be appointed, adding that the government has already started consultation regarding the matter.
During the course of hearing the bench asked that what is hindering the government to delay the appointment of the chairman of judicial commission. Justice Nasir-ul-Mulk observed that the government lingered on the matter for three months without any reason. AAG Agha informed the bench that government was considering few names of the retired judges for the chairman of the commission and it would appoint new head of the commission before the next date of hearing.
On the occasion, K.K Agha also presented the defence committee's report relating to the chronic cases of disappeared persons and told the bench that Fasal Rabi was not considered as disappeared person. Talking about Masood Janjua, K.K Agha said that he had gone to Afghanistan.
Amna Masood Janjua Chairperson Defence of Human Rights Pakistan was also present in the court who said that she was facing life threat by the spy agencies and claimed that her husband was still in their custody. She requested the court to provide her security.
The AAG told the court that spy agencies had already submitted and denied Masood Janjua's custody. "Her case has been disposed of", he added. He informed the bench that her husband had soft corner for al Qaida and had been killed in Afghanistan. Justice Tariq Pervaiz observed that if her husband was killed then fact should be brought to the limelight, adding that protection of lives of citizen is the prime responsibility of the state. The court adjourned the hearing till September 26.
