Aitzaz Ahsan on Wednesday said the government decision not to file a review petition in a contempt of court verdict against Syed Yousaf Raza Gilani could not be called a mistake. Talking to journalists outside Supreme Court building, Aitzaz Ahsan, who was Gilani's lead counsel in a contempt of court case, said he had prepared a 250-page review petition but could not proceed when Pakistan People's Party (PPP) did not deem it necessary to file it.
The main fear of the party, he added, was that Gilani could face disqualification if a review petition was filed. However, the court decided what the party was expecting. He said although a seven-member bench, in its April 26 verdict, had announced that a "question is likely to arise" on Gilani's disqualification, but it did not disqualify him.
"The bench said yesterday that I should have filed an appeal against the verdict," said Aitzaz. "They also said that they cannot amend their decision, I say you [the three-member SC bench] have amended it. You have done what the seven-member bench did not do," he added.
Aitzaz said he had prayed several times before the court that it should not take a decision against individuals because it would leave no room for an appeal. "If tomorrow, the court rules that I am no more a senator, it leaves no room for me to appeal. Hence, suo motu notices are not taken in cases in which the respondent cannot file an appeal," he observed. About writing a letter to the Swiss authorities to reopen graft cases against President Asif Ali Zardari, he said the court would issue new orders to the new prime minister, asking him or her to write a letter.
