IHC gives another opportunity to India to appoint lawyer for Kulbhushan Jadhav

  • AGP says Indian government is not interested in availing the opportunity of legal representation and its focus is to embarrass Pakistan

(Karachi) The Islamabad High Court (IHC) granted another opportunity to India to appoint defence counsel for Research and Analysis Wing (RAW) spy Kulbhushan Jadhav.

The court issued the directions on Thursday after the Attorney General for Pakistan (AGP) Khalid Javed Khan informed the IHC’s larger bench, comprising Chief Justice IHC Athar Minallah, Justice Aamer Farooq and Justice Miangul Hassan Aurangzaib, that the Government of Pakistan has not yet received a reply from the Indian Government.

He said that Jadhav does not want to take the benefit of the International Court of Justice (Review and Reconsideration) Ordinance, 2020, for an effective review of the case, and he had requested considering his mercy plea, already pending before the Pakistan Army chief.

The AGP said that it appears that the Indian government was not interested in availing the opportunity of legal representation and its focus is to embarrass Pakistan.

The AGP observed that Pakistan is continuing the process of implementing the ICJ judgment but, apparently, India is busy obstructing the right to review.

After hearing the arguments, the IHC adjourned the hearing till October 3.

Earlier on July 17, 2019, the International Court of Justice had rejected remedies sought by India, including annulment of military court decision convicting Kulbhushan Jadhav, his release and safe passage to India.

The ICJ also asked Pakistan to review Jadhav's death penalty.
