Income tax law: FBR proposes new definition of word ‘banking’

ISLAMABAD: The Federal Board of Revenue (FBR) has introduced a new definition of ‘banking’ under the proposed draft amendments in the Income Tax Ordinance, 2001 for simplification and harmonization of tax laws.

In this regard, the FBR proposed an amendment in section 2 (definitions) of the Income Tax Ordinance, 2001.

Under the proposed definition of “banking”, it means the accepting, for the purpose of lending or investment, of deposits of money from the public, repayable on demand or otherwise, and withdraw-able by cheque, draft, and order or otherwise, it added.

Sources said that the term of ‘banking’ has been repeatedly used in the income tax law and it needs to be properly defined in the Income Tax Ordinance 2001. This proposed draft amendments in the Income Tax Ordinance, 2001 has been issued for simplification and harmonization through the next Finance Bill, 2024.

The Federal Board of Revenue is currently engaged in exercise for simplification and harmonization of Inland Revenue’s Tax Statutes, i.e., Income Tax Ordinance, 2001; Sales Tax Act, 1990; Federal Excise Act, 2005; Islamabad Capital Territory (Tax on Services) Ordinance, 2001.

The simplification and harmonization of the procedures and processes under each of these statues with each other for uniformity and ease of implementation/ compliance for the tax collectors and the taxpayers is a key priority of FBR.

In this regard, proposed drafts of amendments in the aforesaid Inland Revenue Statutes are hereby published on the FBR website, inviting valuable feedback and comments of the general public and other stakeholders to be provided by Dec 31, 2023. Subsequently, after further deliberations with stakeholders, the proposals will be considered during the preparation of the Finance Bill 2024, FBR added.

The non-filer should end. The NIC number should be the tax number and everyone over 21 should be required to put in a tax return on-line, even if it is a nil return. The on-line self assessment form should not be more than a page long and should be available in Urdu and English. At present 14,000 tax payers pay 75% of our direct taxes; out of a population of 250 million people! It is a good effort that the FBR is trying to simplify the taxation system because at present it is a "Kitcheri" of all kinds of tax bands and duties backed up by numerous SRO's and customs tariffs which have been brought in piece-meal without any overall planning or analysis. At present 51% of of tax income comes from duties on imports, which is not desirable because if imports go down; which we want, we loose revenue. There should be fewer tax bands, customs categories and exemptions. I challenge the FBR to get their tax manual down to 30 pages. Defining the word "banking" is the least of our worries.

Assalamo Alaikum, this definition of "Banking" is same as provided in the Banking Companies Act, 1962.

@Tariq Qurashi, There should be no exemption to any body. Every person must pay tax. Some relaxation to deserving only. Less rate with all network will definitely increase revenue.

Even a bagger pays tax if he buys milk , bread or eggs. Nobody knows where the tax money is disappearing. To make it possible all large trades should be online meaning banking. But the issue is banking sector is constrained by bogus policies. Why would some one put money in bank when banks will be disclosing individuals information. People are recently buying gold for this reason and it's price went up in Pakistan. Instead of giving powers to FBR amendment should be made to make filling easy and friendly because it's not easy and friendly by large.

More could be achieved by introducing more simplifications in the tax collecting procedure. No other efforts will ne fruitful.

@Asif, you fool and above all you have never studied the term direct tax.Indirect taxes are being levied in every state of the World. In middle East they earn by taxing each and every foreigners at every stage. The economy of a country is based on direct taxes. If you study how much an American pay direct tax or income tax then you realise that you are living in HEAVEN of non tax payers.
