The Lahore High Court here Tuesday dismissed an application of Jamaat-i-Islami seeking restrictive orders against Asif Ali Zardari for functioning as President of Pakistan. The court observed that the required relief could not be granted as main petition seeking Zardari's disqualification in light of Supreme Court judgement in Asghar Khan's case was still pending adjudication and its maintainability had not been decided yet.
Farid Pracha of the JI filed the main petition and submitted that the President Zardari from day one had been persistently carrying on political activities as head of state as well as head of a political party. He said a full LHC bench had directed the President to disassociate himself from the office of political party at the earliest but he had been consistently committing disobedience of the order as well as of the Constitution. The petitioner urged the court to declare that the respondent Zardari as head of a political party was not qualified at the time of his nominations for election of the President.
