The investigations into a gun and suicide attack on district court in which 11 persons including Additional Sessions Judge Rafaqat Awan were kille, claimed that Awan was shot by his own guard. However, sources said that Babar Hussain, the official guard of Awan, had denied charges against him before an Anti-Terrorists Court (ATC) on Friday, saying that "he is innocent and that he only fired on terrorists."
Police sources said that according to initial evidence collected by Joint Investigation Team (JIT), Rafaqat Ahmad Khan Awan received two bullet shots fired from an official revolver No.522228D issued on 23.01.2014 to his gunman Constable Babar Hussain, C/4311, Security Division. Awan died inside his chamber behind his courtroom, where his blood littered the floor, with no signs or traces of blood anywhere else, police said.
Source while quoting a report of investigation team said there is no evidence of any distant gunshot of Kalashnikov 7.62 mm (used by terrorists) in the court room, on the door of the chamber or any place/wall inside the chamber. There is evidence of a near contact shot (with gun-powder blackening) on the door of the chamber, which suggests a small entry and not a 7.62mm bullet of Kalashnikov rifle.
They said that police have also found evidence of another shot of revolver on the wooden wall of the chamber fired from inside. He said that there is evidence of two shots on the clothes and body of Awan. The entry hole on the vest clearly shows blackening which proves a near-contact shot from a small arm and not a 7.62mm bullet of a Kalashnikov.
The corroborative evidence mentioned above clearly shows that there is a proof of only four gunshots fired inside the chamber. Three empty casings and a slug (lead) have been recovered, and the official revolver from which they were fired has been taken into custody and dispatched for a forensic examination. The gunman, Babar Hussain, C/4311, who was deputed on a written request of Rafaqat Ahmad Khan Awan, vide memo No.4, dated 15/01/2014, has been formally arrested due to the above evidence. Police have obtained his three-day physical remand from an Anti-Terrorism Court.
