Islamabad High Court comprising Justice Qureshi suspended non-bailable warrants for former army chief and President Pervez Musharraf on condition that he will ensure his appearance before an Additional Sessions Judge in the Lal Masjid cleric Ghazi Abdul Aziz's and his mother's murder case. Justice Qureshi directed the counsel for Musharraf to submit an affidavit regarding his appearance before the court.
Justice Qureshi on Wednesday ordered Musharraf to appear before an additional session judge on April 27, 2015 and advised the counsel that if he did not attend the court on its next date of hearing then the IHC order relating to annulment of his arrest warrants would be cancelled.
IHC Justice Noor ul Haq N. Qureshi after initial hearing in the matter nullified the arrest warrants issued by the trial court judge-additional district and sessions judge (ADSJ) Wajid Ali after Musharraf's counsel assured the presence of former military ruler on April 27 - the next date of hearing.
Additional Session Judge Wajid Ali issued non-bailable arrest warrants for General (Rtd) Musharaf on April 2, 2015 for his repeated absence in the Lal Masjid.
On April 3, 2015, Musharraf filed a petition before Islamabad High Court challenging the non-bailable arrest warrants on grounds of ill health. In his petition filed through Malik Tariq, former military ruler contended that the police after thorough investigation had declared him in the said murder case.
A nine-member committee was formed to examine Musharraf's state of health. On April 1, the former president was finally examined by the medical board. Previously he did not undergo a check-up citing security issues and did not appear before the board members at Sindh Services' Hospital (SSH).
Citing reason for his absence in the proceedings, the petition claimed that on April 2, Musharraf had to appear before a medical board constituted to ascertain his health condition under the direction of Anti Terrorism Court (ATC) Quetta where the case related to the murder of Nawab Akbar Khan Bugti is pending for adjudication.
