Reserving its judgement in response to review plea about construction of Kalabagh Dam on Monday, the Supreme Court asked the petitioner' counsel to submit formulations in the matter in a week.
Earlier, making federal and provincial governments, Ministry of Water and Power, Council of Common Interests as respondents, Engineers Study Forum had urged the apex court to issue directives to the concerned authorities to construct Kala Bagh Dam. However, the Supreme Court declared the plea inadmissible to which the Forum filed review petition through advocate A.K Dogar.
Resuming the hearing of the review plea, a three member bench led by Chief Justice Anwar Zaheer Jamali observed that the matter in hand had been politicised.
The court was of the view that no one's rights were breached in the matter in hand so it has nothing to do with the decisions of the Parliament.
During the course of proceedings, A. K. Dogar contended that no public interest litigation could be dismissed in default or on technical grounds saying that the court can issue directives to Parliament in response to public interest litigation. Dogar also pleaded that apex court cannot take any decision without hearing him at length.
Later, seeking formulations form Dogar, the bench reserved its judgement in the case.
