Ministry of Petroleum and Natural Resources will file an appeal in the Sindh High Court (SHC) in consultation with the Ministry of Finance against the judgement of SHC on Gas Infrastructure Development Cess (GIDC) Act, 2015.
Sources told Business Recorder here on Monday that the appeal filing process is underway and the intra-court appeal would be filed against the judgement of SHC within the specified period of 30 days.
Around Rs 200 billion has been collected under GIDC so far and Rs 120 billion is outstanding against various consumers, they added.
When contacted, Minister of Petroleum and Natural Resources Shahid Khaqan Abbasi said that, "GIDC is a Ministry of Finance issue. They will decide how to proceed further".
Sindh High Court ruled that the collected GIDC amount is liable to be refunded/adjusted in future bills of respective industries/sectors.
A single member bench of the SHC in response to identical pleas filed on October 26, challenging vires of the Gas Infrastructure Development Cess Act, 2015 and Gas Infrastructure Development Cess Act, 2011 and Gas Infrastructure Development Cess Act, 2014 had ruled it ultra vires of the constitution.
SHC ruled that since the amount has already been collected in pursuance of Act 2015, the amount so collected is liable to be refunded/ adjusted in the future bills of the respective plaintiffs.
