A Senate Committee on Delegated Legislation on Thursday discussed a public petition in length to protect rights of the government pensioners and directed officials of Ministry of Finance to amend the relevant rules. A meeting of the committee was held here in the Parliament House in the chair of Senator Taj Haider. The petition was submitted by a citizen, Hammad Nasir.
The committee suggested the amendments in rules of National Savings and Pensioner's Benefit Account (PBA) Rules 2003 to protect rights of the pensioners and their legal heirs. The officials briefed the committee members about the PBA rules and said these rules apply on all retired employees of federal and provincial governments, Azad Jammu and Kashmir, armed forces and autonomous bodies.
They agreed to the issues pointed out by the petitioner that in case of death of the government employee, the pension shall be granted to the nominee(s)/heir(s). They told the committee that rules would be amended accordingly. They assured the committee that they will provide their input to the committee in the coming days.
The chairman of the committee directed the officials to amend the rules in the light of a verdict of Sindh High Court on the issue. Farooq H Naek, a member of the committee clarified that a person cannot distribute or donate his property and assets through a will more than one-third of the total share as law of inheritance comes into play after death of anybody as per Islamic laws. The committee appreciated the point of view of Ministry of Finance and National Savings and directed that the rights of pensioners should be protected at all costs.
