Supreme Court on Tuesday sought documents from Chairman Pakistan Tehreek-e-Insaf Imran Khan about site plan approval of his residential property in Banigala by an authority. A three-member bench led by Chief Justice Mian Saqib Nisar while hearing a suo motu notice taken over application of Imran Khan against illegal construction in Banigala, asked Khan to produce the documents by Feb 22.
Appearing before the bench, the additional attorney general for Pakistan apprised the court that the counsel for Imran Khan, Babar Awan, didn't cooperate on the construction and encroachment issue in response to court's directives, adding that the court had ordered to give suggestions after meeting all the concerned parties.
The additional attorney general suggested that all sorts of construction at Banigala be stopped immediately whereas gas and electricity departments be stopped from issuing no-objection certificates (NOCs) for connections in Banigala.
Babar Awan pleaded that there are three types of properties in Banigala, saying private owners have the permission to use their property the way they want; however, Chief Justice Mian Saqib Nisar said that even then building regulations must be observed.
Awan said that Capital Development Authority (CDA) has nothing to do with private property, adding that there are 33 rural union councils and 17 urban union councils in Islamabad Corporation. He said that constructions around Rawal Dam are illegal. The hearing of matter was adjourned till Feb 22.
