Chief Justice Mian Saqib Nisar on Monday reiterated that the judiciary is not at all interested in intervening in matters of the executive but it is left with no option but to step in when the latter fails to do its job.
He made these remarks while hearing a suo motu case regarding the closure of Bone Marrow Transplant Center (BMTC) by Pakistan Institute of Medical Sciences (PIMS), Islamabad - the sole facility for children suffering from thalassaemia.
The Chief Justice said to Additional Attorney General Amir Rehman that judiciary is doing what the government is supposed to do, and the government should do its job properly.
He further said that Supreme Court interferes in executive matters because the government is not doing its job, adding if the government does its work accordingly, the judiciary would not have to intervene.
The Chief Justice hearing the issue of officials on deputation, said till a final decision on repatriation of health officials who were merged in federal hospitals is taken, no one will be sent back to parent department.
There are many doctors working in different hospitals who were not repatriated despite court orders in 2016 when the officials of other departments were sent back to their institutions.
The report categorized them into five types and recommended to repatriate all health professionals to their parent departments and advised that those lady doctors who come under the wedlock policy can't be repatriated.
