A bar member has challenged the authority of federal cabinet before the Lahore High Court of placing or removing names from the Exit Control List (ECL). The petitioner Munir Ahmad pleaded that as per procedure when courts permit exclusion of a person's name from the ECL, the ministry presents a summary before the cabinet for its approval.
He argued that the courts' directions need to be implemented in letter and spirit by the interior ministry without the role of cabinet. The lawyer argued that in view of settled laws, the power rests with the government to place or delete someone's name from ECL and the federal cabinet has no power to interfere in this matter.
The petitioner therefore prayed the court to declare the exercise of authority and jurisdiction through cabinet, in pursuance of provision of the Exit from Pakistan (Control) Ordinance, as illegal and without jurisdiction.
