Unregistered mobile devices: collector Customs issues procedure for registration
In order to implement instructions contained in Customs General Order (CGO) No.6 dated 29.11.2018 and to ensure transparency and smooth clearance of un-registered mobile devices brought illegally through informal channels, the Collector Customs Jamil Nasir Khan has issued compliance procedure for registration of unregistered mobile devices brought illegally through informal channels.
It may be noted that the Federal Government has launched "Device Identification, Registration and Blocking System (DIRBS)" with effect from 1st December, 2018. Pursuant to said decision, the Federal Board of Revenue (FBR) has issued Customs General Order No.6 dated 29-11-2018, whereby detailed procedure for regularization of unregistered mobile devices has been laid down.
As per the compliance procedure, the Additional Collector of Customs, Air Freight Unit, AIIAP Lahore shall supervise the whole exercise till 31st December 2018. The Additional Collector of Customs, Air Freight Unit, and Deputy Collector of Customs (Admn), Air Freight Unit are authorized to exercise powers of adjudication in terms of SRO 1456(1)/2018 dated 29-11-2018 issued by Federal Board of Revenue. A dedicated "Mobile Registration Counter" shall be set up at Air Freight Unit, AIIAP Lahore immediately for receipt of declaration of unregistered mobile devices.
The holder/proprietor of un-registered mobile devices shall voluntarily approach the "Mobile Registration Counter" at Air Freight Unit, Lahore and file declaration as per Annex-C of CGO No.06 of 2018 along with soft copy of IMEI details of such devices in excel format.
The Customs staff posted at "Mobile Registration Courtier" after detaining the mobile phones and cross-checking the particulars (Type, Brand, Model and IMEI) of presented mobile devices viz-a-viz the declaration shall affix their signatures and official seal on the declaration. A photocopy declaration form shall be retained by Customs staff and original form shall be handed back to the owner of mobile phones. The detained mobile phones shall be deposited in designated place at Air Freight Unit, AIIAP Lahore. The Additional Collector AFU will depute staff to ensure safe custody of the detained mobile phones. The applicant shall approach PTA Authorities for issuance of CoC (Certificate of Compliance) along with relevant documents as explained vide para 7(C) of the CGO 06/2018 dated 29.11.2018.
The applicant/holder shall approach the "Mobile Registration Counter" for release of the mobile phone(s) once CoC is issued. The Customs Appraising Officer specifically deputed for this purpose shall assess the levy able duty/taxes after adjudication proceedings. The holder/applicant shall deposit the duty and taxes in the designated branch of National Bank of Pakistan and the mobile phone(s) shall be released to the holder. In case of non-issuance of CoC, further action for seizure / confiscation shall be taken in accordance with law in respect of detained phone(s).
