Sindh High Court (SHC) Wednesday approved extension in interim bail of former Chief Minister Sindh Syed Qaim Ali Shah till February 4, 2019 in a petition related to call up notice issued by the National Accountability Bureau (NAB) on grant of land to Malir Development Authority (MDA). A division bench of SHC, headed by Justice Muhammad Iqbal Kalhoro resumed the hearing on the petition of former Chief Minister Syed Qaim Ali Shah and adjourned the hearing till February 4, 2019.
According to contents of the petition, CM Sindh granted land to MDA under a policy for incremental housing as per law. Such lands have been granted to Karachi Development Authority (KDA), Lyari Development Authority (LDA) and Sehwan Development Authority as well as Hyderabad Development Authority on the rates fixed by govt.
It contended that former Chief Minister exercised his constitutional authority in good faith and for public purpose and for such acts he is protected under article 248 of the constitution.
It said that the former CM never granted any land to any private organization and NAB's call up notice to him is without lawful authority. Counsel said that former CM exercised such powers under section 10A of the Colonisation & Disposal of government Lands Act
and such action of the CM is protected under the constitution. It stated said former CM strictly followed the legal procedure in vogue and did not deviate an inch from that procedure. The same procedure is being followed by the governments and the rates of government lands are notified after every three years as per market value of the lands.
