imageISLAMABAD: The Islamabad High Court on Thursday issued notice to former president General (Retd) Pervez Musharraf in a plea claiming Rs 750 million as damages for using logo/symbol of Eagle in any manner.

A single judge bench of Justice Muhson Akhtar Keyani initiated hearing of the case filed by Sardar Naseem Ahmed, Chairman Pakistan Freedom Party to restrain All Pakistan Muslim League (APML) from using the symbol of Eagle.

During the course of proceedings, Sardar Naseem Ahmed appeared in person and pleaded his case. He said that the symbol of Eagle had been allotted to his party on December 9, 2007 moreover he contested for three MNA and one MPA seat in general election 2008 with the said symbol.

He argued no political party had any legal or moral right to use this logo in any manner whatsoever but the respondents were not only using it but also making statements that the said logo would be allotted to the APML.

The defendants wrote a letter of intimation on July 5, 2011 to the Chief Election Commissioner of Pakistan to stop using symbol of Eagle and in the letter defendant categorically admitted the use of logo which is documentary admission on behalf of plaintiff's assertion.

He said he sent a legal notice to the Musharraf in this regard claiming damages on 07-06-2011 and raised his grievances, but the defendant continuously claiming the ownership of the symbol which was not allotted to him by the competent authority.

After hearing the arguments at length, the bench issued notice to the respondents to submit their stance and subsequently adjourned the case till March 4.
