The 18-month-old petition against the 7th Journalists Wage Board Award and the service rules of newspaper employees has been listed for the First Bench on next Wednesday.
This is the first regular cause list issued under new Chief Justice Nazim Hussain Siddiqui for the week starting from January 12.
Sitting with the Chief Justice on the bench will be Justice Rana Baghwandas and Justice Tanvir Ahmed Khan.
The petition is being piloted by Barrister Abdul Hafeez Pirzada on behalf of All Pakistan Newspapers Society (APNS) and has been pending for hearing since July 2002.
Representing the newspaper owners, the Society filed the petition invoking direct jurisdiction of Supreme Court questioning the legality of Pakistan Newspapers Employees (Condition of Service Act, 1973) and thus also the wage board created under it.
Another old case seeks initiation of contempt of court proceedings against United Bank Limited by the Middle East Finance and Trading Corporation regarding import of Yellow Cabs from France.
The First Bench will also take up the appeal of Call Tell, a scratch card vendor, questioning levy of advance taxation on its sales.
The Chief Justice has created five benches--two full and three division benches--from among the 13 Judges left after retirement of four of its senior members.
Twenty-six textile related industries have filed petitions questioning the levy of customs duty on their imports while there are 38 petitions from the Pakistan State Oil against its employees in various service related matters.
These all have been clubbed together for hearing and will be taken up by Fourth Bench comprising Justice Javed Iqbal and Justice Abdul Hameed Dogar on Monday.
The other benches are:
Second Bench: Justice Mian Muhammad Ajmal, Justice Hamid Ali Mirza and Justice Khalil-ur-Rahman Ramday.
Third Bench: Justice Syed Deedar Hussain Shah and Justice Faqir Muhammad Khokhar.
Fourth Bench: Justice Javed Iqbal and Justice Abdul Hamid Dogar.
Fifth Bench: Justice Sardar Muhammad Raza Khan and Justice Falak Sher.
These Benches will work for half the week until Wednesday while for the remaining part of the judicial week the first two benches have been reconstituted as under:
First Bench: Chief Justice Nazim Hussain Siddiqui, Justice Javed Iqbal and Justice Abdul Hameed Dogar.
Second Bench: Iftikhar Muhammad Chaudhry, Justice Rana Baghwandas and Justice Tanvir Ahmed Khan.
The Third, Fourth and Fifth Benches will remain unchanged.
