A division bench of High Court of Sindh (SHC) on Friday disposed of a constitution petition filed by an employee of an oil trading firm directing the authorities of Pakistan Coast Guards (PCG) to decide the case of the petitioner in one month's time.
The SHC bench was comprising Justice Anwar Zaheer Jamali and Justice S. Ali Aslam Jaffri.
Malik Shabbir Ahmed moved the court stating that he collects used motor oil from workshops, lubricant dealers from areas along Balochistan coast.
The petitioner maintained that on December 21, 2003, PCG staff posted at Balochistan check post detained two trucks containing oil and despite his efforts are not releasing the vehicle.
It was submitted that no customs or excise duty could be levied on used oil.
When the petition came up for hearing today (on Friday), Deputy Attorney General, appearing for the state, submitted a sample of the oil taken from one of the trucks and stated that the oil was smuggled from Iran.
A case has been registered against the petitioner, the DAG told the court.
The counsel for the petitioner then requested the court to direct the respondents to decide the case of the petitioner within a month time.
The bench allowed the request and disposed of the matter with the direction to the PCG to decide the case within a month.
BAIL PLEA DISMISSED: Meanwhile, Justice Ghulam Rabbani on Friday dismissed as withdrawn a bail application filed by Mohammed Ali Brohi facing a corruption case before a National Accountability Court at Karachi.
When the bail plea came up for hearing before the bench, Raza Hashmi, advocate, appearing for the applicant, said that his client has entered into plea bargain with the authorities of National Accountability Bureau (NAB) and wanted to withdraw the bail application.
The bench, allowing the request, dismissed it as withdrawn.
According to the reference against the accused/petitioner served as executive engineer B&R, MES, Navy Com Pak from 1971 till 2001, he received a total salary of Rs 3.702 million during service but amassed wealth amounting to Rs 13,902,394.
He owned fixed deposit certificates worth Rs 57 million, flour mills, houses, medical centre in the name of his sons and spouses.
