The appeal was filed by Mehmood Ahmed Malik against the order of a single judge Zahid Kurban Alavi, who while deciding a judicial miscellaneous application, declared the People's Steel Mills, second highest bidder as successful.
Rizwan Ahmed Siddiqui and Rana Azeem advocates appearing for the appellant maintained in the appeal that he submitted highest bid of Rs 66.2 million in improved bidding while respondent, the People's Steel Mills submitted an improved bid of Rs 66.1 million.
The bench after hearing the counsel, admitted the appeal for regular hearing and issued notices to the respondents.
The prime land in dispute is located in Valika Nagar, Manghopir, Karachi earmarked for industrial purposes.
Another division bench of the SHC comprising Justice Mohammed Mujeebullah Siddiqui and Justice Zawwar Hussain Jaffery reserved orders in a contempt of court application in respect of Summaya Terrace, KCHS, Karachi.
The suit and contempt application was filed by the Maqbool Co-operative Society against the Karachi Building Control Authority (KBCA).
According to applicant, respondents obtained a permission to construct ground plus one floor, but later started raising a huge commercial plaza. The fifth and sixth floor of the building was later demolished by the KBCA on the orders of the SHC. However, as respondents continued construction activity, the contempt application was filed.
