Mohammad Waris Khan, member of the sub-committee, formed by the chief minister to review legal aspects of the Hasba bill, has denied a news item appeared in a section of the press describing as unconstitutional to refer decisions of the provincial cabinet to the governor for approval.
In a statement issued here on Monday, he clarified that under rules 36 and 37, formed under Article-139 of the Constitution, sending all proposals of legislation to the governor for seeking his consent is a constitutional requirement.
Otherwise, any piece of legislation enacted after bypassing the governor would be considered as invalid, he elaborated.
Mohammad Waris Khan, who is former additional advocate general NWFP, said, "Hasba bill is not something new as similar nature of legislation had already been invoked in all the federating units and at the central level.
However, all the instructions of the holy Quran and Sunnat have been accommodated in clause 23 of the Hasba bill, which made it different from others.
