Muhammad Ikram Chaudhry, the legal counsel of Director Kahuta Research Laboratory (KRL) Major Islamul Haq (Retd.), on Thursday filed a constitutional petition in the Supreme Court seeking opening of FIR against his client who is currently being interrogated by the state authorities for leaking the nuclear secrets of the country.
Petition which has been filed under Article 184(3) of the Constitution states that the petitioner feeling and believing that he is being denied the right to have a copy of the First Information Report (FIR) on baseless and illegal grounds has moved this court by filing a constitutional petition as his constitutional right under Article 4, 9, 25 and other provisions of the Constitution of Pakistan are being violated.
Ikram Chaudhry has maintained that the relatives of his client have made every possible effort to obtain the FIR but the government is hiding the facts and committing violation of the constitutional provision by denying the right of access to justice to his client.
The government of Pakistan and others have been made respondents in the petition.
According to reports, Major Islamul Haq (Retd) was forcibly and without any valid warrant was taken away from the house of Dr Abdul Qadeer Khan on January 17, 2004 by two army officers in uniform.
The detenue is the Principal Staff Officer of Dr Abdul Qadeer Khan and also holds office of Director at KRL Kahuta.
The petitioner has prayed that the government be directed to produce the copy of the concerned FIR to the legal team of the lawyers so that a constitutional and legal requirement be fulfilled.
