The city police chief on Monday was directed, to find the whereabouts of the 'Pesh Imam' of a mosque, by a division bench of High Court of Sindh (SHC) comprising Chief Justice Saiyed Saeed Ashhad and Justice Zia Pervez.
Earlier, Additional Advocate-General Sindh Abbas Ali appeared before the Court along with two DSPs. The AAG submitted written statements by DSP Raja Umar Khattab and DSP Qazi Chand Mohammad on behalf of SSP AVCC and other high officials.
The raid, arrest and custody of alleged detenue Amanullah Rais was denied in these statements.
Ibrahim Rais, father of the detenue, has filed the petition stating that Police party riding in three vehicles raided his house on 12-6-2004 and took away the detenue for some inquiry. The brother and then father/petitioner sent telegrams to all high-ups in Sindh Government informing them of illegal detention of Amanullah Rais, 'Pesh Imam' of Jama Masjid Baghdadi, commonly known as 'Mubarik Masjid'.
Rais is accused of instigating Akbar Niazi, police constable and suicide bomber who carried out suicide attack in Masjid-e-Haidery in May last.
The bench expressed dismay that if he is not in custody as averred by respondent police officials why whereabouts of a citizen who went missing for so many days cannot be traced.
After assurance by AAG that serious efforts would be made to find the missing person, the bench put off further hearing till June 23.
