A full bench of the Supreme Court of Pakistan has granted leave to appeal in a petition filed by Asghar Ali, Nazim of Union Council No 133 and issued notices to the respondents.
The petitioner has challenged the decision of the Lahore High Court, which has upheld the verdict of election tribunal of de-seating the petitioner.
The petitioner was de-seated on an election petition filed by his rival candidate Fakhar Hussain. Fakhar had challenged his election on the point that Asghar had not mentioned the assets of his wife.
The petitioner contended that his family members were independent, hence it was not mandatory to mention their assets in the declaration.
He said that there were ambiguities in the Local Bodies Ordinance and needed interpretation.
The Court after hearing his counsel, Hafiz Abdur Rehman Ansari at length granted leave to appeal and suspended the orders of the LHC.
