Sindh High Court Friday disposed of three identical petitions challenging detention of Mohajir Quami Movement leaders Kamran Rizvi, Zafar Aziz and Asif Sheryar as it were withdrawn by petitioner's counsel.
Syed Noman Rizvi and Salman Aziz, brothers of detained MQM leaders, submitted that law enforcement agencies illegally arrested their brothers on July 15, 2004 and later detained under Maintenance of Public Order (MPO) without any reason, while Ms. Rabia wife of Asif Sheryar also challenged the continuous detention of her spouse.
The court was told by the provincial attorney that Sindh home department has withdrawn the detention order in respect of Zafar Aziz and Kamran Rizvi and they may be released if not involved in other cases. About the detention of Asif Sheryar, court was told that three criminal cases are pending against him.
Petitioner's counsel Khurrum Maqsood, after statement of provincial attorney, did not press the petitions and desired to withdraw it.
SHC's division bench comprising Justice Khliji Arif Hussain and Justice Gulzar Ahmed after withdrawal disposed of the petitions.
SUIT DISMISSED: Justice Gulzar Ahmed of Sindh High Court (SHC) on Friday dismissed the lawsuit for injunction against the partial demolition of the under construction shopping mall on the Daudpota Road Karachi.
The plaint was filed by M/s Chapal builder against the partial demolition of the structure of building Navinta Shopping Mall & luxury apartments situated on plot 221 IE Lines Daudpota road by the cantonment board, for violation of building rules and the approved design.
Plaintiff also sought injunction against the cantonment board and prayed court to direct defendant to approve the building plan submitted by him.
The court in its judgment observed that plaint has no merit and it is hereby dismissed.
