A division bench of the Sindh High Court comprising Chief Justice Saiyed Saeed Ashhad and Justice Zawar Hussain Jaffery on Tuesday disposed of petition challenging alleged detention of former Navy officer as infructuous and asked petitioner to approach authority concerned for legal remedy available to her under law.
Ms Musrat Hakim, naming Nazar Hussain, Navy chief petty officer in Karsaz as respondents, alleged that her spouse Abdul Hakim, who is also retired as Naval officer, was made hostage by the respondent since August 9, 2004.
When the matter was taken up on Tuesday the alleged detenue Abdul Hakim, spouse of petitioner, was present in court.
Assistant Judge Advocate General of Navy Shahbaz Ali appeared before court and denied the allegation of petitioner. He said neither the alleged detenue was arrested nor detained, adding that petitioner's spouse was not wanted in any case.
The court observed that in view of contradictory statements the question regarding alleged confinement could not decide in constitutional petition, and it requires recording of evidence.
Disposing of the petition as alleged abductee present in court as free citizen, the court asked petitioner as regard her contention to move concerned authority for legal remedy provided to her under law.
