The Lahore High Court (LHC) has issued notice to Chairman National Accountability Bureau (NAB) and called for report and comments in a petition, filed by an American national Rana Haider Zaman, praying to the court to direct the respondent to return back his documents.
The petitioner contended that his brother-in-law is involved in litigation with some financial institutions, but he and his family members have nothing to do with his business.
He said that the respondent NAB officials with malafide intentions had called him and his family members and had taken their ID cards and passports in their custody.
He, therefore, prayed to the court to direct the respondents to act in accordance with the law and not to harass the petitioner and his family members. He also prayed to the court to direct the respondent to return back their documents and not to call them in their office again.
The court, after hearing the petitioner counsel at length issued notice to Chairman NAB and called for report and comments by September 21, 2004.
NOTICE TO HOME SECY ISSUED: The Lahore High Court issued notice to Punjab Home Secretary, and called for report and comments in a petition filed against the detention of Muhammad Sarwar, a journalist of Okara.
It has been contended in the petition that the detainee had written a number of news stories about the military forms in Okara, and he was arrested by the police, while the Special Court for Suppression of Terrorist Activities had acquitted him from the charges levelled against him.
The respondent, the Home Secretary, on July 27 issued his detention orders under the Maintenance of Public Order Ordinance for next three months.
According to the petition, the action of the respondent was illegal, unconstitutional, and without lawful authority only to harass and victimise the detainee.
The Lahore High Court has issued notice to SHO Shadbagh for September 3, 2004 and directed him to appear before the court in person, and explain about the involvement of two persons Ghulam Dastgir and Nadeem in al Qaeda activities.
The petitioner, who is father of the detainees, contended that his sons are government employees, working in Pakistan Railways, and are honest and punctual in their prayers. The respondent SHO arrested them illegally and when approached he said that some foreigner during interrogation had given their names and claimed that they are also involved in activities of al Qaeda, he further stated.
The petitioner contended that his sons were neither involved in criminal activities nor were required to the police. He said that the respondent had arrested his sons to make money and then claimed that they had links with al Qaeda.
He, therefore, prayed to the court to direct the respondent to act in accordance with the law and release his sons.
The court, after hearing his counsel at length, issued notice to the respondent and directed him to appear before the court in persons on the next date of hearing.
The Lahore High Court issued notice to Superintendent Kot Lakhpat jail for September 8, and directed him to explain as to why the petitioner, a jail inmate, Muhammad Aslam, was not produced before the court of law for the last five years.
The petitioner contended that respondent with mala fide intentions is shifting him to the Rawalpindi jail, saying the respondent never produced him before the court for the cases pending against him.
He also said when he asked him about this illegal action, the respondent decided to shift him to the Rawalpindi jail.
He, therefore, prayed to the court to direct the respondent to act in accordance with the law, and not to harass the petitioner further.
The court, after hearing the petitioner at length, issued notice to the respondent and directed him to appear before the court in person on next date of hearing.
