DCO Karachi Mir Hussain Ali has said the notification issued in June this year to the effect that no other law than Sindh Building Control Ordinance is applicable on the Karachi Building Control Authority (KBCA) clashes with the SLGO. He requested the local government department to withdraw this notification immediately.
In a letter to Local Government additional chief secretary, the DCO clarified four relevant points.
He said as per the notification of April 30, 2004, the Sindh government had created a group of office in the City District Government Karachi (CDGK) called the 'Building Control Group' of office, which provides legality to the KBCA, part of the City District Government Karachi.
He said according to Section 27 (2) of SLGO, a group of office shall be headed by an executive district officer, thus the chief controller of buildings is an EDO as per SLGO.
The DCO pointed out that as per section 26 (2), the DCO shall be the co-ordinating head of the district administration and shall initiate the performance evaluation report of the EDOs.
Further in the explanation of this sub-section, the expression of the co-ordinating head has been defined as the Authority to call for review and assess the performance of groups of offices individually and collectively.
He said this is also supported by rule 6 and 7 of the District Government (Conduct of Business Rules) framed by the Government of Sindh.
He said under SLGO, section 3 overrides all other laws and no office or group of offices functioning within the CDGK can be declared to be excluded from the ambit of SLGO.
The DCO said these facts clarify that the KBCA is part of the District Government DCO as administrative head of the CDGK is totally authorised to keep an eye on the working of all the CDGK departments.
