The five-member Shariat Appellate Bench of the Supreme Court will continue to sit for the second week to clear the big backlog of appeals against Federal Shariat Court decisions.
The Bench consists of three career judges Justice Abdul Hameed Dogar, Justice Muhammed Nawaz Abbasi and Justice Shakirullah Jan and two religious scholars Justice Dr Allama Khalid Mahmood and Justice Dr Rashid Ahmed Jullundhari.
The most important of all cases listed in the new cause list of the Bench is interpretation of Islamic law of evidence on point of a distinction between the evidence of man and woman.
Another appeal is against the rejection of Khushbakht-ur-Rahman's petition by Federal Shariat Court which had questioned Punjab Government's ban on betting at horse races. The petition had challenged the jurisdiction of Section 2 of the Punjab Prevention of Gambling Ordinance of 1978 and is listed for hearing on October 13.
The quota system in the services is the subject matter of other appeals moved by a large number of petitioners from Sindh and NWFP.
Besides the Appellate Bench, there will be three full benches sitting to hear a number of civil and criminal appeals and also questions relating to assessment of excise or custom duties or the income tax on private corporations. There is a sizeable number of cases seeking adjudication in the matter of service. The three benches are composed as under:
FIRST BENCH: Chief Justice Nazim Hussain Siddiqui, Justice Javed Iqabl and Justice Tassadauq Hussain Jillani.
SECOND BENCH: Justice Iftikhar Muhammad Chaudhry, Justice Rana Baghwandas and Justice Hamid Ali Mirza. From Thursday and Friday, this Bench will function without Justice Baghwandas who will be proceeding on short leave.
THIRD BENCH: Justice Syed Deedar Hussain Shah, Justice Sardar Muhammad Raza Khan and Justice Faqir Muhammad Khokhar.
