The Lahore High Court Multan Bench judge has sought written explanation from Punjab Local Government secretary, Muzaffargarh DCO and others with in 30 days for not paying honoraria to lady councillors despite provision in the Local Government Ordinance and the honourable court also sought reasons for delaying in paying the honoraria.
The LHC judge has also called written explanation from Muzaffargarh DCO to submit reasons for not implementing upon the ordinance sections 39 and 113, which entitle the lady councillors for honoraria.
Earlier, senior lawyer Abdul Aziz Niyiazi filed a petition before LHC Multan bench judge Justice Molvi Anwarul Haq and petitioner Muzaffargarh tehsil lady councillor Huma Nawab Abbasi stating that the administration and the government representatives were reluctant to release honoraria to them despite provision in the LG Ordinance.
The petitioner made Punjab Local Government secretary, Muzaffargarh district Nazim, tehsil Nazim and DCO as respondents in her petition for implementation upon releasing honoraria.
According to LG Ordinance section 113, the district government, tehsil administration, town administration and union administration shall make budgetary provisions for honoraria and allowances of the Nazims, Naib Nazims and allowances for the members of concern council, which shall be charged to the respective local fund.
The section 39 (Q) also declared about the honoraria and allowances of the elected representatives.
The petitioner took a stand that she and her other colleagues drew attention of respondents to comply with the mandatory provision for paying the honoraria and travelling allowance but all in vain.
Even the district council members with majority passed the resolution of release of honoraria on submitting their item on April 23, 2004 but implementation upon the passed resolution could not be made.
The petitioner lady councillor Huma Nawab's counsel informed the court that all the provinces were paying the honoraria and travelling allowances except Punjab province.
The petitioner said that they were being treated discriminatory as the Nazims were getting the honoraria compared to lady councillors.
The petitioner prayed the honourable court to direct the concerned respondents to explain the reasons and ground for not releasing honoraria and travelling allowance to lady councillors as required under section 39 and 113 of LG Ordinance 2001.
The LHC Multan judge Justice Maulvi Anwarul Haq sought written explanation from respondents and directed the Muzaffargarh DCO submit reasons in delaying implementation upon the orders of paying the honoraria and travelling allowances to the lady councillors.
