Lahore High Court (LHC) dismissed a petition filed by a member of the Lahore High Court Bar Association (LHCBA) praying to the court to exclude poppy from the definition of intoxicant and also allow use of poppy for medicinal purpose. The petitioner also prayed to the court to declare award of capital punishment on the charge of possession of poppy as illegal and unconstitutional.
The court, while rejecting the petition, observed that the petitioner had no locus standi in the matter. The court also observed that the court could not direct the legislature for making laws in accordance with the prayers made by the petitioner.
The petitioner M.D. Tahir contended that a number of countries in the world were using poppy for medicinal purpose, but the respondent government imposed ban over its cultivation.
The court, after hearing the petitioner at length, dismissed the petition for not maintainable.
