Justice Syed Shabbar Raza Rizvi of the Lahore High Court (LHC), while declaring the circular issued by Inspector General of Punjab Police regarding re-investigation as illegal and issued without authority, has directed Sessions Judge Khushab to proceed with trial of the case on the basis of challan submitted before him on the basis of investigation conducted earlier.
The court passed these orders in a petition against the orders of District Police Officer (DPO) Khushab directing re-investigation in a murder case got registered by one Ahmed Nawaz.
The court observed that spirit of article 18(6) of Police Order 2002 was to discourage re-investigation.
The court further observed that a departmental circular or rules made under the concept of delegated legislation couldn't be allowed to exceed or frustrate the main statue. The court also observed that if re-investigation was directed as provided under Article 18(6) of Police Order that would not be effected by this order.
CIVIL JUDGE MADE OSD: The Lahore High Court (LHC) Chief Justice Iftikhar Hussain Chaudhry has transferred senior civil judge Sheikhupura Khawaja Muhammad Ajmal to LHC and posted him as officer on special duty (OSD).
The Chief Justice also placed the services of District and Sessions Judge Muhammad Latif Qureshi at the disposal of Law, Justice and Human Rights Division Islamabad for his posting as Special Judge (Central) Faisalabad with immediate effect.
