A division bench of High Court of Sindh (SHC), comprising Justice Wahid Bux Brohi and Justice Musheer Alam on Wednesday dismissed as withdrawn a constitution petition filed by PPPP leader Asif Ali Zardari challenging non-issuance of passport to him by the Regional Passport Office. When the matter came up for hearing, the bench was informed the passport had been issued to the petitioner and also his name had been excluded from the Exit Control List (ECL). The petition, had served its purpose and thus be allowed to be withdrawn.
The bench acceding to the request by counsel for petitioner dismissed the same as withdrawn.
The same bench, while modifying an interim order passed by a bench of SHC allowed Zardari to keep guards with weapons while use of vehicle with tinted/black glasses was declared violation of law.
"We agree with the contention of Advocate General of Sindh that use of tinted glasses has been denied to every body and thus no such request can be granted in case of petitioner," the bench observed holding use of tinted glasses as absolute violation of law in place.
No objection shall be raised if the petitioner and his men carry licensed weapon with valid permits, the bench said. The bench, then adjourned hearing of the plea till January 14, 2005.
