A division bench of High Court of Sindh (SHC) comprising Justice Sarmad Jalal Osmany and Justice Mohammad Mujeebullah Siddiqui on Friday granted bail to an accused in Cyber crime case. Ch Umar Azmat, booked under section 420.468/471/34 P.P.C by CID police on a complaint by Shahid Mehmood, Fraud Management Analysis Unit of Union Bank Limited, sought bail after his bail plea was rejected by trial court (Special Court for Offences in Banking Circle).
The complainant named the accused/applicant in FIR alleging that he (applicant), in league with co-accused Naveed Khan, Khair Mohammad and others used skimmed counterfeit credit cards on Union Bank's electronic machines kept at different merchants like petrol pumps etc. The bank maintained that the applicant/accused caused a loss of Rs 3,55,000.
Amir Mansoob Qureshi, appearing for accused Umer, submitted that none of the sections under which accused was booked fell into prohibitory clause and even some of the sections are non-cognisable.
He also submitted that the accused had been falsely implicated and yet was ready to deposit the amount of alleged fraud attributed to him.
The bench, after hearing the state counsel, admitted the accused to bail against a solvent surety of Rs 3,55,000.
