The appeals, involving two private power companies and another by former federal minister Jehangir Badr against the National Accountability Bureau (NAB), were adjourned by the Supreme Court to different dates in the next month here on Monday. Chief Justice Nazim Hussain Siddiqui fixed new dates after the government lawyers pointed out that the first bench that he was presiding was short of one judge as Justice Javed Iqbal was on short emergency leave and hence it did not hear the cases that were decided by the full benchs of the provincial high courts.
The cases were an appeal by Spencer Powergen Limited, a joint venture with Awari Group that had lost its performance bond to the Private Power Infrastructure Board (PPIB) and a government appeal in similar circumstances against the Lahore High Court decision, ordering refund of Rupali Power Company's bank guarantee.
Because of the similarity of situation and grounds, the Supreme Court has clubbed the cases for simultaneous hearing. Now it will be heard on April 11.
Akram Sheikh had appeared for Spencer Powergen, while Syed Ali Zafar and Haider Zaman Qureshi represented the Rupali Group.
Because of the same reasons, the appeal of Jehangir Badr was adjourned by the same bench to April 12. Akram Sheikh appeared for the former Pakistan Peoples Party (PPP) federal minister for Science and Technology.
