A news item with the caption "KESC asked to complete transmission lines in SITE" appeared in the Business Recorder of April 14, 2005 wherein it has been reported that Dr Ikhtiar Baig successfully negotiated with Premier Battery and finally they have withdrawn their suit No 724/2003 from the SHC.
It is clarified in order to keep the record straight that M/s. Premier Battery filed suit No 724/2003 and 1072/2003 and obtained interim injunction from the High Court of Sindh restraining KESC from the installing of high tension cables/poles over and above their factory premises.
The said that interim injunction was confirmed by the SHC vide order dated October 28, 2003 against which the KESC filed an appeal before the Division Bench of the SHC bearing No HCA 416/2003 and 417/2003 on 24.11.2003. Both the said HCAs were dismissed by the Division Bench of SHC on 17.2.2004.
Later on the KESC preferred to file an appeal against the judgement passed by the division bench of SHC before the Supreme Court of Pakistan which was pending for hearing.
In the meantime the KESC approached the plaintiff for an out of court settlement through the Managing Director, SITE Ltd, and agreed to file a compromise application before the SHC.
The compromise application was accepted by the SHC and the suit No 724/2003 and 1072/2003 were decreed against the KESC in terms of the compromise application.
It is clarified that no suit was withdrawn by M/s. Premier Battery and only an out of court settlement through a consent decree against KESC was agreed upon.
