The Supreme Court of Pakistan, while dismissing a petition filed by Education Department in limine, has observed that favouritism is crippling our society and it is dishonesty to deprive a person from his due right. The apex court while rejecting the appeal of Education Department, challenging the decision of Service Tribunal, which allowed promotion of vice-principal Government Degree College for Deaf Lahore, Riffat Tanvir with back benefits, observed that it is not against the public interest to provide a right to a deserving person.
According to details Riffat Tanvir had approached the Service Tribunal through Rabiya Bajwa advocate and contended that her promotion was due since 1995, but the respondent government officials instead of promoting her adopted an ex-cadre person and deprived her client of due promotion. The Tribunal, after hearing petitioner's counsel, allowed the petition and directed the respondent government to allow her due promotion along with back benefits. The respondent government officials ignored the court orders.
The petitioner again approached the Tribunal through contempt petition as a result of which respondent officials implemented the court orders from the day of the court orders. The department also approached the Supreme Court of Pakistan against the decision of Service Tribunal. The court, after hearing both the sides at length, upheld the decision of the Service Tribunal and dismissed the petition in limine.
