A two-member bench of the Supreme Court headed by Justice Muhammad Nawaz Abbasi on Thursday heard the appeal filed by an APP employee Ilyas Bhatti against the judgement of Federal Services Tribunal (FST).
The bench of the Apex Court heard the point of view of the Associated Press of Pakistan Corporation (APPC) Managing Director Fazalur Rehman Malik.
APPC MD Fazalur Rehman appeared before the court in person on a notice issued by the Supreme Court on August 5.
The managing director explained the matter before the court regarding leave application submitted by the petitioner Ilyas Bhatti and informed the Apex Court that the said application was processed according to the rules and regulations without any discrimination by the department and not refused as claimed by the appellant.
He also informed the court that the petitioner Ilyas Bhatti is in the habit of resorting to litigation and had filed 16 cases during his service against the department at various times which were infractions because of lack of substance in the eyes of the law.
The court observed that the department did not refuse Ilyas Bhatti's leave application and there was no cause of action regarding the petition. The court also observed that the appellant seems to be a habitual litigant.
The court asked the appellant that he should have satisfied the department and should have provided the address and the name of the country, he wanted to visit during his ex-Pakistan leave.
