The sister of detained al Qaeda leader Khalid Sheikh Mohammad on Wednesday filed application in Sindh High Court (SHC) seeking production of his brother before the court contending he was still detained by the federal government. Ms Marium has challenged the detention of her relatives by law enforcement agencies (LEA) in Pakistan.
She alleged LEA, besides her son Ammar Ali Abdul Aziz, an alleged al Qaeda financier, earlier arrested his brother Khalid Sheikh Mohammad, two sons-in-law Abdul Basit alias Ramzi Yousuf, Abdul Qadir and nephew Abdul Karim Mehmood alias Abu Moosab after US invasion on Afghanistan on suspicion of their links with al Qaeda.
The application was filed by her counsel Ghulam Qadir Jatoi submitting that foreign minister in his reported statement on August 23, 2005, published in newspapers, admitted that detainee Khalid Sheikh Mohammad was in the custody of government of Pakistan and he was not handed over to US government. Besides, he stated, custody of detainee is further proved as military court in Pakistan has sentenced six Army personnel for having connection with extremists and one Army officer Major Adil Qadoosi was convicted as detainee was recovered from his house in Rawalpindi in February 2003.
It was submitted the detainee was still in the custody of federal government and the authorities concerned are not producing him before the court deliberately.
The matter was taken up before SHC's division bench comprising acting Chief Justice Ghulam Rabbani and Justice Azizullah M Memon. Federal law officer Mehmood Alam Rizvi waiving notice sought time from the court to collect information regarding the detention of detainee. The court granting request fixed the matter for October 13, 2005.
