The National Tariff Commission (NTC) has imposed provisional anti-dumping duty on polyester filament yarn (PFY) being imported from four East Asian countries.
These four countries are Indonesia, Korea, Malaysia and Thailand. The imposed duty would be effective from November 12, 2005, for a period of four months.
Based on examination and analysis, the Commission has made a preliminary determination that PFY was classified under Pakistan Customs Tariff code 5402.3300 and 5402.4300 as dumped product and was being exported to Pakistan at dumped prices (less than the normal price of the product).
According to NTC, the duty structure for four exporters/producers from Indonesia would be P.T.S.K Keris (4.19 percent), P.T PanAsia (27.78 percent), P.T Sulindafin (12.00 percent). And, for all others exporters, it levied 15.55 percent duty, whereas it levied no duty on P.T Indorama.
ON KOREAN PFY EXPORTERS THE DUTY LEVIED IS: Hyosung Corporation (29.07 percent), Hualon Corporation (36.56 percent), Tongkook Corporation (zero duty) while all other exporters from Korea would pay 8.92 percent duty on PFY export to Pakistan.
THE DUTY STRUCTURE FOR MALAYSIA IS: Hualon Corporation (M) Sdn (14.80 percent), Global Trade Well (24.84 percent), Fotex Trading (22.97 percent) and for all others 14.80 percent.
Thailand exporters, Tutex will pay 18.93 percent duty, Chiem Patana 29.68 percent, Jong Stit Company will pay no duty and all other exporters from the country will pay 18.93 percent duty on the product export to Pakistan.
The Commission has also asked the interested parties (exporters, importers and domestic industry) to present their views in a hearing and submit their brief views on a particular issue or issues to the Commission up to 30 days before the date of final determination.
The investigation was initiated on May 12, 2005 by the Commission in response to an application filed under the Anti-Dumping Duties Ordinance, 2000, by the association of domestic producers of PFY, ie Filament Yarn Merchant Association, Karachi on behalf of domestic product manufacturing industry.
Polyester filament yarn is chiefly used as raw material in the manufacturing of artificial silk fabrics and garments by the loom and circular knitting operators.
It may be recalled that the import of PFY used in manufacturing of goods for export purposes has been exempted from all duties and taxes under the DTRE scheme. Therefore, the Commission says that the imposition of anti-dumping duty would have no impact on the imports of PFY that are used for exports. This is the seventh investigation conducted under the Ordinance.
